Terms of Service
1. Acceptance of Terms
By accessing or using Shift Copilot ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users including individual supervisors, site managers, and organisations using the Service under a pilot or paid arrangement.
2. Description of Service
Shift Copilot provides an AI-powered tool that converts unstructured shift notes (voice or text) into structured shift handover reports for use in mining operations. The Service is designed to support — not replace — the professional judgment of Statutory Supervisors and safety personnel operating under the Work Health and Safety (Mines) Regulations 2022 (WA) and related legislation.
3. AI-Generated Content — Important Disclaimer
Shift Copilot does not warrant that any report generated by the Service:
- Is accurate, complete, or free from errors
- Meets all requirements of the WHS Mines Regulations 2022 or any other applicable law
- Will be accepted by WorkSafe WA, DMIRS, or any other regulatory body
- Is suitable for use in any specific operational or legal context
4. User Responsibilities
By using the Service, you agree that you are responsible for:
- Reviewing and verifying all AI-generated report content before sign-off
- Ensuring your use of the Service complies with all applicable WA mining laws and your site's safety management system
- Obtaining any necessary consents from workers whose information may appear in shift notes
- Maintaining appropriate records and backup copies of handover reports
- Not entering sensitive personal information beyond what is operationally necessary
- Ensuring supervisors understand that AI-generated content requires human verification
5. Intellectual Property
Shift Copilot and all associated software, design, and content is owned by Jordan de Boer trading as Shift Copilot. You retain ownership of the shift note content you input and the reports generated from your content. We do not claim ownership of your operational data.
You may not copy, reproduce, modify, or distribute the Shift Copilot application or its underlying code without written permission.
6. Limitation of Liability
To the maximum extent permitted by Australian law:
- Shift Copilot is provided "as is" without warranties of any kind, express or implied
- We are not liable for any direct, indirect, incidental, consequential, or special damages arising from your use of the Service
- This includes but is not limited to: workplace incidents, regulatory fines, business interruption, data loss, or reliance on inaccurate AI-generated content
- Our total liability to you in any circumstances is limited to the fees paid by you to us in the 12 months preceding the claim, or $100 AUD, whichever is greater
Nothing in these Terms excludes liability for fraud, death or personal injury caused by our negligence, or any liability that cannot be excluded under the Australian Consumer Law.
7. Indemnification
You agree to indemnify and hold harmless Shift Copilot and its operator from any claims, damages, losses, or costs (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any applicable law or regulation.
8. Acceptable Use
You must not use the Service to:
- Input false, misleading, or fabricated shift information
- Process information in violation of any applicable privacy, surveillance, or employment law
- Attempt to reverse engineer, copy, or replicate the Service
- Interfere with the Service's infrastructure or security
- Use the Service for any purpose other than legitimate operational shift handovers
9. Third-Party Services
The Service relies on third-party providers including Anthropic (AI processing), Vercel (hosting), and Formspree (form submissions). We are not responsible for the availability, accuracy, or conduct of these third-party services. Your use of the Service constitutes acceptance of their respective terms and privacy policies.
10. Pilots and Paid Arrangements
Pilot access is provided free of charge for a defined period agreed between Shift Copilot and the customer. Pilots may be terminated by either party at any time with 7 days notice. Any paid arrangements will be governed by a separate written agreement. These Terms apply during any pilot period unless superseded by a signed agreement.
11. Termination
We reserve the right to suspend or terminate your access to the Service at any time if you breach these Terms, misuse the Service, or if we determine continued access poses a risk to the Service or other users. You may stop using the Service at any time.
12. Changes to Terms
We may update these Terms as the Service evolves. We will update the "Last updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of Western Australia and the Commonwealth of Australia. Any disputes will be subject to the jurisdiction of the courts of Western Australia.
